CE Course Description
This course addresses some of the more frequently asked questions about when it is appropriate under the Privacy Rule for a health care provider to share the protected health information of a patient who is being treated for a mental health condition. In addition, relevant reminders about related issues, such as the heightened protections afforded to psychotherapy notes, a parent’s right to access protected health information, the applicability of Federal alcohol and drug abuse confidentiality, and the intersection of HIPAA and FERPA in a school setting will be discussed.
CE Course Objectives
- Identify instances when HIPAA permits health care providers to communicate with a patient’s family members, friends, or others involved in the patient’s care.
- Discuss HIPAA guidelines concerning communication with family members when the patient is an adult and when it is permissible to communicate with the parent of a minor patient.
- Evaluate when it is appropriate for health care providers to speak with family members, law enforcement, or others if the patient presents a serious and imminent threat of harm to self or others.
- Clarify HIPAA provisions for enabling health care providers to listen to family members about their loved ones receiving mental health treatment and to discuss treatment adherence with them.
